TERMS OF SERVICE – TAMIA EVENTS

Welcome to Tamia Events. These Terms of Service (“Terms”) govern your access to and use of our event equipment hire services, website, and all related services offered by Tamia Events. By accessing our website, requesting a quotation, booking our services, hiring equipment, or using any of our event solutions, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

  1. INTRODUCTION

Tamia Events is a professional event solutions company based in Kenya, specializing in the hire of event equipment for private, public, and corporate functions. Our services include, but are not limited to, the rental of tents, chairs, tables, décor items, public address systems, lighting equipment, staging, catering equipment, and event setup services.

These Terms are intended to ensure a clear understanding between Tamia Events and our clients regarding the use of our services, responsibilities, and legal obligations.

  1. ACCEPTANCE OF TERMS

By making a booking, signing a quotation, paying a deposit, or using our website and services, you confirm that you have read, understood, and accepted these Terms. These Terms form a legally binding agreement between you (“Client,” “Customer,” or “User”) and Tamia Events.

Tamia Events reserves the right to update, modify, or revise these Terms at any time without prior notice. Any changes will become effective immediately upon posting on our website. Continued use of our services after such changes constitutes acceptance of the updated Terms.

  1. SERVICES OFFERED

Tamia Events provides event equipment hire and event support services for a wide range of occasions, including weddings, graduations, conferences, exhibitions, birthday parties, funerals, church gatherings, corporate events, and social functions.

Our services may include:

• Tent hire and setup
• Chair and table hire
• Sound systems and public address equipment
• Stage and lighting equipment
• Décor materials and event accessories
• Catering equipment hire
• Event transportation and delivery
• Event setup and dismantling services

The availability of any equipment or service depends on prior booking confirmation and operational capacity.

  1. BOOKING PROCESS

All bookings with Tamia Events are subject to availability and official confirmation.

Booking requirements:
• Clients must provide accurate details of the event, including date, venue, location, and equipment requirements.
• Bookings may be made via phone call, email, website contact forms, or in person.
• A booking is only considered confirmed after acceptance by Tamia Events and payment of any required deposit.

Tamia Events reserves the right to reject or cancel a booking if:
• Required equipment is unavailable
• Incorrect or misleading information is provided
• Payment terms are not met
• Safety or legal concerns arise

  1. PRICING AND PAYMENT

All prices quoted by Tamia Events are subject to change without prior notice unless confirmed in writing.

Payment terms:
• A deposit may be required before reservation of equipment
• Full payment must be completed before or on the event date unless otherwise agreed
• Additional charges may apply for transport, setup, dismantling, overnight hire, or extended use
• Payments can be made via M-Pesa, bank transfer, or any approved payment method

Failure to make payment on time may result in cancellation of the booking without liability to Tamia Events.

  1. DELIVERY, INSTALLATION, AND COLLECTION

Tamia Events offers delivery, setup, and collection services depending on the client’s location and service package.

Delivery conditions:
• Clients must provide accurate venue location and access instructions
• Delivery times are agreed in advance but may vary due to weather, traffic, road conditions, or unforeseen circumstances
• Setup areas must be safe, accessible, and suitable for installation
• Clients must ensure that the venue owner permits event equipment installation

Tamia Events is not liable for delays caused by circumstances beyond our control.

  1. CLIENT RESPONSIBILITIES

The client agrees to:

• Provide truthful and complete booking information
• Ensure adequate space and security for hired equipment
• Take reasonable care of all equipment during the hire period
• Prevent misuse, theft, damage, or unauthorized relocation of equipment
• Notify Tamia Events immediately in case of damage, malfunction, or loss

Clients are responsible for ensuring that all guests and third parties use the equipment safely and properly.

  1. DAMAGE, LOSS, AND THEFT

All hired equipment remains the sole property of Tamia Events.

The client shall be fully responsible for:
• Loss of equipment
• Theft during the hire period
• Intentional or accidental damage
• Damage caused by negligence, misuse, weather exposure, fire, or vandalism

Tamia Events reserves the right to charge the client the full repair or replacement cost of any damaged, lost, or stolen items.

  1. CANCELLATIONS AND REFUNDS

Clients may cancel bookings subject to the following conditions:

Cancellation policy:
• More than 7 days before event: may qualify for partial refund
• Less than 7 days before event: deposit may be non-refundable
• Same-day cancellation: no refund unless otherwise approved

Refund decisions are made solely at the discretion of Tamia Events and may account for preparation, transportation, and labor costs already incurred.

  1. EVENT DELAYS AND EXTENSIONS

If an event runs beyond the agreed hire period:
• Additional charges may apply
• Tamia Events must be informed in advance where possible
• Overnight or extended hire requires prior approval

Late collection due to client delays may attract extra charges.

  1. FORCE MAJEURE

Tamia Events shall not be held liable for failure or delay in performing services due to events beyond reasonable control, including:

• Floods
• Heavy rainfall
• Fire
• Road closures
• Strikes
• Civil unrest
• Government restrictions
• Natural disasters
• Power failures

In such cases, Tamia Events may reschedule services or offer reasonable alternatives without liability.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Tamia Events shall not be liable for:

• Indirect losses
• Loss of profits
• Business interruption
• Event cancellation losses
• Personal injury caused by misuse of equipment
• Damage caused by third-party vendors
• Delays outside our control

Our total liability shall not exceed the amount paid by the client for the specific booking.

  1. SAFETY AND USE OF EQUIPMENT

Clients must ensure hired equipment is used safely and only for intended purposes.

Tamia Events is not responsible for injuries or accidents resulting from:
• Improper setup by unauthorized persons
• Client misuse
• Unauthorized modifications
• Overloading or incorrect operation

Tamia Events reserves the right to refuse setup in unsafe locations.

  1. INTELLECTUAL PROPERTY

All website content, text, branding, images, logos, service descriptions, and materials on Tamia Events website are the property of Tamia Events unless otherwise stated.

You may not:
• Copy content
• Reproduce materials
• Use our logo
• Republish website images
• Use our branding for commercial purposes without written permission

  1. WEBSITE USAGE

By using our website, users agree not to:

• Submit false bookings
• Upload harmful content
• Attempt unauthorized access
• Interfere with website functionality
• Use automated tools to scrape content

Tamia Events reserves the right to suspend access to any user violating these conditions.

  1. PRIVACY AND DATA PROTECTION

Tamia Events collects client information for service delivery, customer support, quotations, invoicing, and legal compliance.

Information collected may include:
• Name
• Phone number
• Email address
• Event location
• Booking details

We do not sell personal information to third parties. Information may only be shared where required by law or necessary to deliver services.

  1. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of Kenya.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of Kenyan courts.

  1. TERMINATION

Tamia Events may terminate service agreements immediately if:
• The client breaches these Terms
• Payment is not made
• Equipment is misused
• Fraudulent activity is suspected
• Unsafe conditions arise

Termination does not affect outstanding payment obligations.
